Our site review has two components, one manual, and one powered by our WaaveCompliance Plugin, so let’s start by installing our tech on your website

How to install WaaveCompliance:

  1.  Access your WAAVE Dashboard and locate your credentials. Profile > Configuration

  2. Here are the instructions for each eCommerce platform Download & Install instructions

  3. Please read the instructions carefully, once you successfully install the plugin our compliance team will be review your inventory.

  4. Issues installing the plugin?  Start a Ticket for tech support.

If you sell Hemp Seeds...

  • Age Gate at landing 21+ 

  • Breeders & growers need a license by State in accordance with the 2018 Farm Bill

  • Resellers do not need licenses

  • Resellers must show a disclaimer saying that the items are a novelty

  • Disclaimer about growing only in legal states/countries and in accordance with local law is mandatory for all Seed merchants

  • Shipping limitations you cannot ship to Kansas or Kentucky
    “Our seeds are sold as novelty items and souvenirs. They contain 0% THC. We encourage our customers to check the legislation in their Country, State or Province, and Municipality prior to purchasing items from this store. In the US, we do not ship to Kansas or Kentucky due to State Legislation” 

  • The site cannot have any GROWING advice. No comments related to flowering times or plant coverage. You CAN talk about the unique genetics but cannot imply it should be planted.

If you sell CBD...

  • Age Gate at landing 18+  

  • Hemp CBD can be shipped to all 50 states, but you require a license to ship to NY or LA

  • You can only ship 0% THC CBD to Kansas

  • Cannot ship internationally

  • WAAVE does not accept CBD with more than 0.3% THC

  • No medicinal, disease-related, or therapeutic benefits claim

  • Mandatory FDA disclaimer that needs to be placed on the home page for the store

    A COA is valid if:

  3. It has the exact name of the product on it, if you have flavors, each flavor must have a unique COA

  4. It has your company name on it. If you didn’t send the sample for testing but a supplier/vendor did, you must provide us with an invoice that shows the relationship between your company and the supplier.

  5. The COA is for the end product, not the parts.​

If you sell Other Hemp Cannabinoids...

  • Age Gate at landing 21+ 

    Delta 8

  • There is a lot of chat on Delta 8, and the rumor in DC is that with the Farm Bill of 2023 the legislators will close the loophole that makes Delta 8 legal to sell without a cannabis license, linking its fate to THC. We suggest you do not overstock the product.

  • FDA disclaimer is mandatory

    “Due to state laws we do not ship smokable hemp to the following locations: Georgia, Hawaii, Iowa, South Dakota, Indiana, Arkansas, North Carolina, Kansas”

    Vapes

Vaping law changed in 2020  While the shipping ban by USPS has not been implemented yet all vaping products are being moved to the ATF purview

These are the WAAVE requirements for merchants who carry these products:

  • Proof of private carrier shipping approval

  • Proof of ATF registration (Register here)

  • Proof of age verification on every order (upload ID) or subscription to WAAVE’s Age Check system.
     

  • Include the appropriate disclaimer:

     “{name of your company} is registered with the ATF for the sale of vaping products and we ship these items via {name of private courier} We implement a mandatory ID verification to ensure this item is not sold to underage customers. We are fully compliant with the new PACT Act”
